SALES TERMS & CONDITIONS



*I hereby instruct Pattaya Jomtien Property to act as sales agent (hereafter referred to as the "agent") on my behalf in respect of the sale or rental of my property as detailed above. This will be on a non-exclusive basis until sold, at an agreed commission rate of 5% for sales, which is non negotiable and based on the actual agreed final negotiated sales price. I understand that the definition of a "sale" is that should a client who the "agent" introduces to me and/or views the said property, agree to purchase the said property at any time within twelve (12) months of viewing it with the "agent", either by making the purchase offer directly and correctly through the "agent" or by circumventing the "agent" by means of the client or his representative contacting me direct, that should I accept a purchase offer or any subsequent offer from the agent, his client or his representative, then I accept the said sales commission as stipulated above is due payable to the "agent" when the "agents client" pays a deposit of at least 10% of the purchase price or when the property is transferred into the purchasers name, which ever is first.



*Should I at any date after signing this Listing Agreement, offer this same property to any other agent as an "Exclusive Listing" and I do not inform Pattaya Jomtien Property in writing to cancel this Listing Agreement, then this listing agreement remains valid and will take precedent over any other Listing Agreement I sign and Pattaya Jomtien Property will retain their full 5% commission should they conclude a successful sale or rental of this property.
